Terms of service

These terms govern your use of the Lumina Movement Studio website and mobile app, and your attendance at classes booked through them. By creating an account you agree to them.
Lumina Movement Studio is a limited liability company in formation in the State of New York, at 2767 Route 44/55, Gardiner, NY 12525.
Your account
- You must be 18 or older to hold an account. A parent or guardian must hold and manage the account for anyone younger.
- Give us accurate details and keep them current. We use your email address to confirm bookings and to tell you when a class is cancelled.
- Your account is yours alone. Keep your password to yourself, and tell us promptly if you think someone else has it.
- We may suspend an account that is used to abuse the booking system, our staff, or other students.
Booking a class
- Booking window. Classes open for booking 14 days ahead.
- Waitlist. If a class is full you may join the waitlist. If a place opens up, we book you into it automatically and email you — you do not need to accept. If you cannot then make it, cancel as you would any booking.
- Guests. You may bring a guest using a guest pass. You are responsible for your guest while they are at the studio, and they must complete our waiver before taking part.
Canceling, and missed classes
This is the section people care about, so it is stated plainly.
- Cancel more than 12 hours before a class starts and there is no charge and no penalty. Any class credit is returned to your account.
- Within 12 hours, you cannot cancel yourself. Call the studio. Whether we release the place and return your credit is at our discretion, and we will use it kindly — but the place is held for you and someone on the waitlist could have taken it.
- If you do not turn up, we do not charge you anything extra. The class credit, pass or membership you booked with is used for that class.
- If we cancel a class — an instructor is unwell, the weather closes the grounds — we will tell you as soon as we can and return in full any credit or payment used for it.
Memberships, packs and passes
- Memberships renew automatically, every month or every year as the plan states, at the price shown when you bought it, charged to the card or bank account you pay with, until you cancel. A membership renews on the same date each month or year as your first payment (in a month too short to have that date, on its last day). To stop a renewal, cancel before its renewal date. You can cancel online at any time from Membership in your account, by choosing Manage billing; your membership then runs to the end of the period you have already paid for, and nothing more is charged.
- Class packs are a fixed number of classes. Each pack states when it expires, counted from the day you buy it, on the plan you choose and on your membership page; a class booked before the pack expires is yours even if the class itself falls later.
- Day passes cover a single class and expire after the period stated on the pass, counted from purchase. The pass is used when you book, not when the class runs, so you can buy today for a class next week.
- Guest passes do not expire while your account is active.
- Prices may change. A change never affects a period you have already paid for. If the price of a membership you hold is going up, we email you at least five business days, and no more than 30 days, before the change, so you can cancel before it applies. If you are charged a higher price you did not agree to, you can cancel within fourteen days of that charge and we will refund the unused part of the period.
- Payments are processed by Stripe. We do not see or hold your card or bank account number.
Refunds
Class packs, day passes and guest passes are non-refundable once bought, except where the law requires otherwise or where we cancel a class and cannot offer you a reasonable alternative. If something has gone wrong, talk to us — we would rather sort it out than stand behind a clause.
At the studio
- Arrive in time to settle before the class begins. We may give your place away if you arrive after a class has started, for the safety of everyone warming up.
- Tell your instructor about injuries, pregnancy or any condition affecting what you can safely do. You know your body; they do not.
- Our grounds are twenty-one acres of uneven natural terrain. Outdoor sessions carry the ordinary risks of being outdoors, including weather, ground conditions, insects and wildlife.
- Treat staff and other students with courtesy. We may ask anyone to leave who does not.
Assumption of risk and limitation of liability
Physical exercise carries a risk of injury. By taking part in classes at Lumina Movement Studio you accept that risk. You confirm that you are physically able to take part, and that you have consulted a doctor if you have any reason to doubt it. You are responsible for working within your own limits, and for stopping when you should.
To the fullest extent permitted by New York law, Lumina Movement Studio, its members, staff and instructors are not liable for indirect, incidental or consequential damages arising from your use of the studio, the website or the app. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for gross negligence or wilful misconduct.
You may be asked to sign a separate waiver before your first class. That waiver sits alongside these terms.
The website and app
- We aim to keep the service available but do not guarantee it will never be down.
- Do not attempt to break, probe or overload the service, or to access anyone else’s information.
- The content, branding and software are ours and remain ours.
- If a booking fails because of a fault on our side, tell us and we will put it right.
Privacy
Our privacy policy explains what we collect and why. It forms part of these terms.
Changes
We may update these terms. If a change materially affects you we will tell you by email before it takes effect. Continuing to use the service after that means you accept the change.
Governing law and venue
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Ulster County, New York, and you and we both consent to that venue.
